Terms of Service

By accessing or using DoodlePal ("Service," "we," "our," or "us") at doodle-pal.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DoodlePal

DoodlePal provides an AI-powered platform that allows users to:

• Upload photos of drawings and physical toys
• Generate animated digital characters from uploads
• Engage in interactive conversations with AI-generated character personalities
• Create puppet shows with multiple characters
• Generate bedtime stories featuring created characters
• Store created characters in a personal gallery
• Access educational features and learning tools

Billing Terms

• Payment: Subscriptions are billed monthly in advance. Payment is processed on the day you subscribe and on the same day each subsequent month.
• Payment Methods: We accept major credit cards and other payment methods through our payment processors (Stripe, PayPal).
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
• Price Changes: We may change subscription prices with 30 days' notice. Changes apply to subsequent billing periods after notice.
• Taxes: Prices exclude applicable taxes. You are responsible for all taxes associated with your subscription.

• Free Trial: New users may receive a free trial period for paid plans. Trial terms will be clearly disclosed at signup.
• Trial Cancellation: You may cancel during the trial period to avoid charges. If not cancelled, you will be automatically charged at the end of the trial.
• Promotional Offers: We may offer promotional discounts or features. Promotional terms will be specified at the time of offer.
• One Trial Per User: Free trials are limited to one per user and may not be combined with other offers.

Content You Upload

Content Ownership: You retain ownership of all content you upload (photos of drawings, toys, etc.).

License to Us: By uploading content, you grant us a limited, non-exclusive, royalty-free license to process and animate your uploaded images, generate AI-powered characters and conversations, store content in your account, and display content to you within the Service.

Prohibited Conduct

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to bypass Service limitations or restrictions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Impersonate others or create fake accounts
• Collect information about other users
• Upload viruses or malicious code

No Ownership Claim: Content generated by our AI systems (animations, character dialogues, stories) is created for your personal, non-commercial use.

AI Content Filtering: We use AI systems to filter generated content for age-appropriateness and safety. However, no automated system is perfect.

Parental Supervision: Parents and guardians are responsible for supervising children's interaction with generated content.

Our Intellectual Property

The Service, including all content, features, functionality, designs, logos, graphics, software, and documentation, is owned by DoodlePal and is protected by copyright, trademark, and other intellectual property laws.

Trademarks: "DoodlePal," our logo, and related marks are trademarks of DoodlePal You may not use these without written permission.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

Your Intellectual Property

You retain ownership of content you upload. However, you are responsible for ensuring you have rights to upload content and represent that uploaded content does not infringe third-party rights.

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

The Service may integrate with or link to third-party services:

• Payment Processors: We use Stripe and PayPal for payment processing. Their privacy policies and terms apply to payment transactions.
• AI Services: We use third-party AI providers to generate content. These providers are bound by strict data processing agreements.
• Analytics: We may use third-party analytics services to improve the Service.
• Third-Party Links: The Service may contain links to external websites. We are not responsible for the content or practices of third-party sites.

You agree to indemnify, defend, and hold harmless DoodlePal, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your uploaded content or any infringement of third-party rights
• Any negligent or wrongful conduct on your part

Termination by You

You may terminate your account at any time by using account deletion in your settings or contacting support@doodle-pal.com. Upon termination, all your data will be permanently deleted within 30 days.

Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You upload prohibited content
• Your payment fails and remains unpaid
• We are required to do so by law
• We believe your account poses a security or safety risk

Informal Resolution: Before filing a legal claim, you agree to contact us at legal@doodle-pal.com to attempt informal resolution. We will attempt to resolve disputes informally within 60 days.

Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.

Class Action Waiver: You agree that disputes will be arbitrated only on an individual basis and not as a class action, consolidated action, or representative action.

Opt-Out: You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@doodle-pal.com with "Arbitration Opt-Out" in the subject line.

We may modify these Terms at any time. Changes will be effective immediately upon posting for non-material changes, and 30 days after notice for material changes.

We will notify you of material changes via:

• Email to your registered address
• Prominent notice on the Service
• In-app notification

Acceptance of Changes: Continued use of the Service after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.

• Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and DoodlePal.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign without restriction.
• Force Majeure: We are not liable for failure or delay due to circumstances beyond our reasonable control.
